故意伤害案件，是发案率比较高的案件，我们对一年来所承办的案件进行了调研。

一、案件发生原因：多系因民间矛盾引起，或因琐事与被害人发生争执并互殴。

二、审理法院：基层法院。

三、法院适用程序：多数法院决定简化适用刑事普通程序，实行独任审判，公开开庭合并审理此类案件。

四、涉及到的证据：被害人陈述、证人证言、现场勘察笔录、现场示意图及现场照片、人体损伤程度鉴定书及伤检照片、工作说明、到案经过及被告人的户籍证明、医疗费专用收据、转院证明及诊断证明、出租汽车专用发票、误工证明、民事调解协议及收据等，五、法院判决：一般为三年以下有期徒刑。

1、认定构成犯罪的理由：

查明的事实与公诉机关指控的内容一致。被告人对起诉书指控的犯罪事实没有提出异议。

2、法院对被告人从轻或者减轻判决的理由： 1）、被害人身体所受损伤程度为轻伤。

2）、此类案件的民事赔偿部分，经法院主持调解，双方已协议解决，并已实际履行。或被告人自愿将赔偿款预交至本院。

3）、初犯，认罪态度好，已赔偿被害人损失并得到被害人谅解。4）、被告人案发后主动到公安机关投案，并如实供述犯罪事实，应属自首，对其可依法从轻处罚。

5）、被害人一方的行为亦有不妥之处，六、法院对附带民事诉讼的认定

法院对附带民事诉讼原告人提出的医药费、误工费、交通费中的合理部分，予以支持。

对于附带民事诉讼原告人要求赔偿其后期治疗费、营养费、护理费的诉讼请求，因其不能向法院提供相关的证据佐证，法院本院对诉讼请求不予支持；其后期治疗费可在相关费用发生后再另行起诉；

对于要求赔偿精神损失费，不属刑事附带民事赔偿范围，法院不予支持。

监督与农机管理站站长，家住xx县xx镇滕子坪54号。因本案于x年x月x日经xx县人民检察院决定被刑事拘留，同月11日经检察院变更强制措施为取保候审，现在家。

xx县人民检察院以凤检刑诉字(2009)第39号起诉书指控被告人莫xx犯玩忽职守罪向本院提起公诉。本院依法组成合议庭，于x年x月x日公开开庭进行了审理。xx县人民检察院指派检察员石x、代理检察员田x出庭支持公诉，被告人莫xx到庭参加诉讼，现已审理终结。

xx县人民检察院起诉书指控，被告人莫xx在担任米粮乡安全生产监督与农机管理站站长期间，工作严重不负责任，不认真履行xx县交警大队委托行驶道路交通安全监督管理职责，致使“三无”车辆上路载客，导致该乡发生5人死亡，8人受伤的特大交通事故。该院认为其行为已构成玩忽职守罪，要求适用《中华人民共和国刑法》第三百九十七条第一款之规定，追究其刑事责任，请依法判处。

被告人莫xx对xx县人民检察院起诉书指控其在担任米粮乡安全生产监督与农机管理站站长期间发生特大交通事故的事实没有异议，但辩解提出：“其并非不认真履行安全监督管理职责，因社会环境以及群众不配合，导致个人无法完全履行职责，致使发生特大交通事故，请求从轻判处。”

经审理查明，被告人莫xx于x年x月x日经xx县安全生产管理监督局和xx县农业机械管理局联合任命为凤xx米粮乡安全生产监督与农机管理站站长。同年9月20日，xx县交通警察大队以凤公交(2007)8号文件授权全县各乡镇安全生产监督管理站(简称安监站)实施部分道路交通安全监督管理行政处罚权，即对辖区内车属单位、车主、驾驶人进行道路交通安全教育及培训、上路查究交通违法行为;依法查处违法驾驶、非客运车辆载客、疲劳驾驶、酒后驾驶、无证驾驶、报废拼装车辆上路行驶等违法行为。莫xx在担任米粮乡安全生产监督与农机管理站站长期间，不严格履行职责，虽对辖区农用机动车进行登记并督促农用机动车进行年检、上户、办证、上路查究违法行为，但未采取相应措施促使农用车司机年检、办证，致使该辖区有多名司机无证驾驶，多台“三无”车辆上路行驶，对农用机动车上路载客的违法行为制止、处罚力度不够，给道路交通安全留下隐患。x年x月x日xx镇赶集，xx乡芭科村村民石xx无证驾驶湘xxxxx号牌照变形拖拉机在乡政府所在地载客13人前往禾库赶集，当车行驶至米粮——禾库线3km路段时，车辆翻下路坎，造成5人死亡、8人受伤的特大交通事故。事故发生后，被告人莫xx伙同乡政府干部及时赶往事发现场进行施救和处理善后工作，并及时对全乡安全生产进行检查和整治。

上述事实，经庭审质证认证，有如下证据证实：

1、被告人莫xx的供述，证实其在任乡安全生产监督与农机管理站站长期间，对辖区内无证驾驶及“三无”车辆进行登记并督促办证和年检、上路查究违法行为，因群众不配合，个人无法制止、杜绝、处罚无证驾驶和“三无”车辆上路行驶，导致发生交通事故的事实;

2、证人石xx、吴xx、吴xx等人证词，均证实其于x年x月x日伙同他人搭乘石xx拖拉机前往禾库赶集，途中翻车致人死亡、受伤的事实;

4、证人吴xx、石xx、石xx、石xx的证词，均证实其驾驶“三无”农用车上路被乡安检人员查纠和教育，并要求进行年检，办证的事实;

5、xx县交警大队“凤公交(2008)8号”文件，证实凤凰县交通警察大队授权委托全县乡镇安监站实施道路交通安全监督行政处罚权的事实;

6、现场勘查笔录、证实交通事故发生的地点情况;

7、法医学鉴定书，证实龙xx、吴xx等人乘坐石xx农用拖拉机翻车致其死亡的事实。诸证据具有关联性且能相互印证，予以认定。

本院认为，被告人莫xx在担任乡安全生产监督与农机管理站站长期间，不完全履行职责，对无证驾驶、“三无”车辆上路行驶、非客运车辆载客等违法行为的查究、制止、处罚力度不够，导致辖区车辆违法载客发生特大交通事故，其行为已构成玩忽职守罪，应追究其刑事责任。但该特大交通事故发生，并非其直接行为造成，应从轻处罚。其请求从轻处罚的辩解理由成立，本院予以采纳。据此，依照《中华人民共和国刑法》第三百九十七条第一款、第三十七条之规定，判决如下：

被告人莫xx犯玩忽职守罪，免予刑事处罚。

如不服本判决，可在接到判决书的第二日起十日内，通过本院或者直接向xxxx中级人民法院提出上诉。书面上诉的，应当提交上诉状正本一份，副本二份。

民商案件判决申请执行

(一)、执行案件包括：

1、当事人申请人民法院执行由本院一审并已发生法律效力，具有执行内容的民事判决书、裁定书、调解书和支付令，以及刑事判决书、裁定书中有财产执行内容的案件;

2、上级人民法院交付执行或者同级人民法院委托执行的案件;

3、当事人申请执行公证机关依法赋予强制执行效力的公证债权文书的案件;

4、当事人申请执行仲裁机关作出的仲裁裁决书的案件。

5、行政机关依据生效的行政处罚、处理决定向人民法院申请执行的案件。

其他组织的，其委托在中华人民共和国司法部取得律师执业资格并执业的律师代为申请执行时，比照民事案件的要求办理委托手续。

当事人申请强制执行之前，必须取得执行申请权登记。登记后案件移送执行局，由执行局调查被执行人的财产。被执行人有财产可供执行的，申请人应以查证的财产作为执行标的申请强制执行。被执行人没有财产或其财产不足以执行的，由执行局向申请人发给《执行申请权登记凭证》，日后被执行人有财产可供执行时，申请人可凭《执行申请权登记凭证》向法院申请强制执行。

(二)、执行申请权登记程序

1、对于已生效的法律文书，申请人应当在法定期限内向人民法院提出执行申请权登记请求，由立案庭依法审查并决定是否予以登记。

2、申请人申请执行申请权登记，应当向人民法院提交下列材料：

(1)执行申请权登记申请书和执行申请权登记表：申请书和登记表应当写明申请人所了解的被执行人的财产状况，并由申请人签名或盖章;登记表还需原审法官签名确认法律文书的效力。

(2)生效的法律文书原件一份，复印件二份(如法律文书为公证机

关依法赋予强制执行力的公证债权文书，则还应提交相关的合同原件;如法律文书为生效的劳动争议裁决书，则还需提交劳动争议仲裁委员会送达双方当事人仲裁裁决书的送达回证复印件或该裁决书生效的证明)。

(3)申请人的身份证明文件：申请人是法人或其他组织的，应持营业执照副本并提交营业执照复印件、法定代表人(负责人)身份证明书原件、法定代表人(负责人)的身份证的复印件;申请人是自然人的，应持有个人居民身份证并提交身份证的复印件;委托代理人代为申请登记的，应当同时提交授权委托书和代理人身份证明。

王某自2001年7月即在甲公司上班，任甲公司的前厅经理。2013年7月，甲公司进行部门整合，将王某从前厅经理调整为客户经理。王某不同意甲公司的安排，甲公司根据《员工手册》的规定，解除了与王某的劳动关系。解除劳动合同前王某月工资8000元。王某认为甲公司违法解除劳动合同，要求甲公司支付双倍赔偿金19.2万元。

【法院判决】

【说明】

一、本判决书供各级人民法院依照检察院抗诉或者当事人申请再审程序，对于一审或者二审判决、裁定已经发生法律效力的行政案件，经提起再审或者指令再审程序之后，依法组成或者另行组成合议庭，按照一审或者二审程序再审终结，就案件的实体问题作出处理决定时使用。

二、制作再审行政判决书，应当贯彻实事求是、有错必纠的原则，体现再审程序的特点。

三、判决书的首部，要写明对本案进行再审的根据。可分为四种情况表述： 第一，××××人民检察院于××××年××月××日提出抗诉。

第二，本院于××××年××月××日作出(××××)×行申(监)字第××号行政裁定，对本案提起再审。

五、“本院认为”部分，要有针对性和说服力，要注重事理分析和法理分析，兼顾全面审查和重点突出。针对再审申请请求和理由，重点围绕争议焦点，就原审判决及被诉行政行为是否合法，再审申请理由是否成立，再审请求是否应予支持等，阐明维持原判或者撤销原判予以改判的理由。具体写法可参照二审判决书理由部分。检察院抗诉的，还应对检察院抗诉的请求和理由进行审查。

六、“判决结果”部分可分为以下三种情形： 第一，全部改判的，写：
