一、结婚是在校大学生的权利, 具有法律依据

我国现行的多部法律均未对在校大学生结婚做出限制, 相反, 取消在校大学生“禁婚”的规定是其应有权利的回归。

首先, 婚姻自主是宪法赋予公民的基本权利。《宪法》作为我国的根本大法, 其49条规定:“婚姻、家庭、母亲和儿童受国家保护。禁止破坏婚姻自由。”

其次, 《婚姻法》也遵从宪法精神且未规定例外情况, 其第2条规定:我国实行的是婚姻自由的基本制度。第5条明确说明:结婚必须是出于男女双方完全自愿的基础上, 任何一方都不可以对于他方进行强迫, 第三者也不可以干涉他人的婚姻。而在第6条禁止结婚的条件中, 也并未包含在校大学生不得结婚的规定。

此外, 《民法通则》也规定了婚姻自主权是公民依法享有的一项人身自由权利, 是一项当事人对自己人身的排它性的支配权。婚姻是法律认可男女两性结合形式其特征在于:当事人自主结合, 他人无法替代。

因此, 我们有理由说, 大学生具有结婚的权利和自由, 其结婚权应排除任何单位或者个人的干涉, 不得擅自提高或者降低法定的婚龄和结婚的条件, 更加不能侵犯法律赋予的结婚权。

二、结婚受实际情况的影响, 存在诸多问题

一方面, 从在校大学生自身来看, 其虽然在年龄上已满足了缔结婚姻的条件, 但从经济实力、心理状况、社会责任等方面来说, 结婚还是存在较多问题。

其一, 从在校生经济实力来说, 通过调研发现, 我国大学生与国外许多国家的成年子女不同, 其没有独立的生活来源, 85.6%还是靠家庭的经济支持, 能够取得经济独立的在校大学生少之又少, 只占到6.2%。而婚姻不是许下山盟海誓就能持久, 生活也不是脱离了柴米油盐的空中楼阁, 经济基础是婚姻生活不可或缺的一环, 若没有经济来源的两个人组建家庭, 可想而知其面临着巨大的压力, 婚姻关系也将难以维系, 从这个角度看, 在校大学生是不适宜结婚的。

其二, 从在校生心理状况来说, 其与已经走入社会多年缔结婚姻的夫妻相比, 缺乏必要的社会经历的考验。在校大学生的世界观、人生观、价值观初步形成, 并不十分成熟, 责任感、自制力、承受力较弱, 因此很难快速适应由学生角色向配偶角色、父母角色的转变, 加之如今90后大学生易冲动的性格, 在校期间结婚也欠妥当。

其三, 从在校生社会责任来说, 其与其他群体相比理应承担更多的社会责任, 努力学习, 更好的回报社会是义不容辞的职责。诚然, 学生之所以称为学生, 说明学习还是主要任务, 特别是在高校毕业生逐年递增, 就业形势日益严峻的今天, 不掌握好专业知识, 努力提高自身能力, 为走入社会打下坚实的基础, 于未来, 只能是一纸空谈。而婚姻涉及两个家庭、几代人的关系, 家庭琐事、生养子女等, 使得原本纯粹的校园爱情变得复杂, 使得原本单纯的学生时代变得世俗化, 同时也必将牵扯学生一定的学习经历, 这与学生的主要任务是大相径庭的, 因而其结婚也不恰当。

另一方面, 从高校管理的角度出发, 大学本是一片教育学生努力学习、奋发图强的净土, 是培育人才的摇篮, 然而在校大学生一旦结婚便会引发一系列问题。

首当其冲的是休假问题。结婚不仅意味着两个人过日子, 还带有孕育下一代的责任, 那么婚后女方怀孕, 学校是不是应该参考劳动保障法的规定批准休假待产?生育之后, 是不是应该给予其三个月的产假?这些休假需不需要后期补上, 以至延后毕业?这不是讲故事, 这就是现实。

接下来便是住宿问题。婚后的男女双方已不再是小情侣同居的关系, 而是受法律保护的夫妻关系, 是夫妻必然要共同居住、共同生活。那么学校是否应该为结婚的大学生提供“夫妻宿舍”?对此类宿舍是否应和普通宿舍同等管理, 定期检查?是否应单独为已婚大学生设立宿舍楼?诸如类似的问题还有很多。

再者便是教学任务安排的矛盾。对待已婚和未婚的大学生需不需要分别安排课程?女方休假期间落下的课程, 学校是不是应该提供补课平台?那么补课平台的搭建费用从哪里来?教师补课的课时费谁来出?在我国教育经费并不十分充裕的条件下, 这些问题的解决仍是一个漫长的过程。而这些问题不解决, 就难以实现学生结婚权利与学校管理制度的平衡。

三、笔者关于大学生结婚权的看法

首先一点, 应当承认结婚是在校大学生不可剥夺的一项基本权利, 这是对公民人身权利的尊重。但是, 依法享有结婚的权利, 可以自由行使结婚权并不等于在校大学生就应该结婚, 这也就是说, 大学生应结合自身实际做出理性的选择:

(一) 经济独立, 再做校园新郎新娘

“曾经在幽幽暗暗反反复复中追问, 才知道平平淡淡从从容容才是真”正如歌中唱到, 风光热闹的婚礼过后, 迎来的便是日趋平淡的生活, 这个时候, 仅有山盟海誓是靠不住的, 必要的经济来源才是支持婚姻顺利走下去的基础。有人说, 婚姻是人们在一定的生产方式下体现生产资料所有制和社会分配关系的一种经济行为及其相互关系, 也即所谓的经济基础决定上层建筑。大学生往往仅凭一腔热血, 甜言蜜语便草草结婚, 谈及金钱便觉伤感情, 太物质, 很庸俗, 但这就是现实, 依靠家庭供给生活来源的大学生很难体会“花钱虽易, 挣钱不易”, 也自然很少“且花且珍惜”。因而, 只有当大学生真正走入社会, 经历过, 付出过, 才能清楚肩上的担子, 才能明白婚姻不是儿戏。

(二) 理性选择, 拒绝无谓的牺牲

牡丹江医学院的学生王某, 其在校期间结婚并生下孩子, 因而被学校开除。在被开除时, 她已经通过了所有课程的考试, 只差3个多月就可以顺利毕业。然而, 因为没有取得学位证书, 王某很难找到工作。目前她租住在牡丹江市郊的一个工厂宿舍区, 没有正常的暖气供应。丈夫一年前失业, 闲赋在家。一家人靠出租原住房的200元差价生活, 十分窘迫。

审视王某的经历, 最大的遗憾不是和母校的不欢而散, 而是在仓促的选择中丢掉了自我。若她肯等一等, 也许收获的不仅是美好的爱情, 还有满意的工作。由此也对在校大学生起到警示作用, 婚姻面前, 理性选择。

再者, 尽管解除“禁婚”规定在社会各界引起了激烈的讨论, 但实际上, 真正结婚的在校大学生并不多见, 笔者对自己所在学校的部分学生进行了实地调查, 99.2%的学生在问及“是否会选择在大学结婚时”都给出了否定的回答, 他们认为权利是应当拥有并受到保护的, 法律不应该剥夺在校大学生缔结婚姻的自由权利, 但权利是可以放弃的, “能不能结婚”和“会不会结婚”是两码事, 多数在校大学生在深思熟虑后能够做出较为理性的选择。

因此, 赋予在校大学生结婚权本无可厚非, 但是要对之加强正确的价值观引导, 帮助其做出理性的选择, 平衡好学生结婚权利与学校管理制度的关系。象牙塔内成就的当是更多的人才, 走向社会成就的才当是美满婚姻。

大学生毕业后结婚，此事应该没有多大争议，然而由此延伸出的另一种现象，却值得深入关注和讨论——如果大学生在校期间结婚，你是支持还是反对？

法律允许在校大学生结婚

过去，国内高校是不允许在校大学生结婚的。原国家教委在1990年颁布的《高等学校学生管理规定》第30条明确指出“对于在校学习期间擅自结婚而未办理退学手续的学生，作退学处理”，因此几乎没有听说在上世纪九十年代有在校大学生结婚。

然而1980年修订的《中华人民共和国婚姻法》（以下简称《婚姻法》）规定：“结婚必须男女双方完全自愿，不许任何一方对他方加以强迫或任何第三者加以干涉。”同时规定：“结婚年龄，男不得早于二十二周岁，女不得早于二十周岁。”也就是说，在法律规定中，无论是不是大学生，只要是自愿，符合年龄要求，且没有法律所载明的禁止结婚的情况，就可以结婚，任何第三者不得加以干涉，这个“任何第三者”既包括亲属，也包括高校。

由上可见，当时的行政规定与法律条文之间存在某种冲突。

进入21世纪后，部分高校试点“开禁”。2001年12月，武汉大学允许在校本科生结婚；2004年5月，天津师范大学新闻传播学院三年级学生王洋和天津大学在读博士研究生刘航在天津结婚，成为媒体公开报道的国内首对在校大学生夫妻。

2005年9月，新的《普通高等学校学生管理规定》正式施行，备受争议的“在校大学生结婚就退学”这一规定被废除。2007年8月，原国家人口计生委、教育部和公安部联合发文，对在校已婚女大学生生育问题作出规定，从法规的层面彻底废除了过去的“禁育令”，允许在校女大学生生育孩子。

应该说，新的《普通高等学校学生管理规定》废除“在校大学生结婚就退学”，是尊重法律的体现，说明行政管理部门及社会的法律意识在不断提升。毕竟，结婚作为公民的一项基本权利，理应得到保障。

可是，法律允许了，就代表在校大学生就可以毫不顾忌地自由结婚吗？

法律允许并不代表值得提倡

众所周知，法律规定是从保障人基本权利的角度出发的，它只是社会、团体及个人行为的最低底线。而在法律之上，还有道德准则、社会伦理、物质条件等客观因素。只有综合考虑诸多客观因素，才能对在校大学生是否应该结婚做出理性判断。

教育部政策法规司司长孙霄兵指出，教育部门尊重学生作为成人的权利，但从大学生本身来讲，应该妥善处理好学习、婚姻、家庭三者的关系。大学生在校期间尚不具备婚姻基础，也不具备经济基础，草率结婚容易带来诸多问题，因此还是不提倡大学生在校期间结婚。

大学生在校期间结婚，对自己发展不利。结婚乃人生大事，决非儿戏。尽管多数大学生的生理基本成熟，但心理还有待发展，尤其是还缺乏社会历练、生活经验和思想准备，过早步入婚姻殿堂，难以承担家庭的责任和义务，加上没有经济来源，只能向父母伸手，增加父母负担不说，还不利于培养自身的独立精神。况且，学生在校期间的首要任务是学习，一旦有了家庭负担，难免会影响学业，制约了自身的发展。

中国社会调查所（SSIC）进行的一项电话调查显示，虽然有57%的被访者赞同取消“在校大学生结婚就退学”的规定，但也有69%的被访者不赞成大学生在校期间结婚。许多被访者认为，如果自己的子女选择在大学期间结婚，自己会持反对意见，并会让子女慎重考虑。

不少高校教师也不赞成大学生在校期间结婚。武汉大学政治与公共管理学院副教授尚重生认为，“大学生夫妻”年纪小，从情侣到夫妻，生活从激情归于平淡，他们面对的变量和不确定因素非常多，如果双方能相互理解、相互支持，也许能维持婚姻，但如果一方成长非常快，另一方却依旧幼稚，这样的婚姻“散场”的可能性就很大。

爱情是美妙的，但恋爱绝不等同于婚姻。仅凭一腔热情和“海誓山盟”结婚是不够的，当柴米油盐成为生活的主旋律，当家庭琐事占据了大部分精力，此时需要的不仅是爱情，更是一份责任。可是，在校大学生真的做好承担责任的准备了吗？有媒体梳理了近十年来在校大学生结婚的案例，得出一个基本结论：90%左右的当事人后悔当初的选择，认为在校期间结婚，太过草率和仓促。

高校要引导学生树立正确的婚恋观

从法律的角度而言，尽管说我们不应过多去干预在校学生结婚的权利，但从教育的角度来说，学校有责任劝导学生不要滥用这样一种权利。

就目前来看，尽管在校期间结婚的大学生毕竟是少数，多数在校大学生都能理性对待这一人生的重大选择，但学校还是要“以小见大”、未雨绸缪，通过多种举措，引导学生树立正确的婚恋观和人生观。

学校可以通过开设选修课、讲座、讨论会等形式，把社会主义荣辱观的要求融入大学生婚恋教育中，向大学生灌输主流的婚恋价值观。要注重对男生加强责任教育，对女生加强自尊自爱教育，旗帜鲜明地反对不正确、不健康的异性交往方式。

学校要引导学生以学业为重，在校期间注重个人素质的提升，为日后的人生、家庭打下良好基础。学校应开展多种形式的实践活动，让学生开拓视野，陶冶情操，提高人生境界和个人品位，可通过校园文化艺术节、社会实践活动和其他公益活动，丰富大学生的校园生活，多方位满足大学生的精神需求，充实他们的大学生活，提高他们的综合能力。

心理专家指出，大学生在生理上已达到成熟水平，但在心理方面还需继续发展。因此，学校应加强大学生心理健康教育，让他们掌握全面的心理健康知识与方法，提高他们的恋爱心理素质与承受能力，从而让他们正确面对恋爱，避免做出不理智的行为和选择。

学校还应加强法制教育，向大学生宣传和解释与规范婚姻关系相关的法律知识，引导大学生正确认识婚姻的权利与义务。在两性关系中，要让大学生认识到哪些行为是合法的、哪些行为是违法或犯罪的，不断增强大学生的法制观念。

近年来，不少高校都开设了有关婚恋教育的选修课，如：河南农业大学的韩宁老师开设《婚姻家庭法学》选修课，原定306人上的课，结果竟然有近2 000人报名；华东师范大学的洪亚非老师开设《婚姻与爱情》选修课，原定84人上的课，报名接近500人……这从一个侧面说明大学生对爱情与婚姻知识的渴求。

大学生婚恋观正确与否，对其学习、生活有着重要的影响，更关乎着他们未来的发展。高校应该进一步关注大学生的婚恋心理，为学生的成长成才服务。

关于在校研究生结婚和申请生育管理的暂行规定 为贯彻执行中华人民共和国《人口与计划生育法》、《婚姻法》、《山东省人口与计划生育条例》等法律法规和《山东中医药大学研究生管理实施细则》的有关规定，加强计划生育和晚婚晚育的教育，使我校研究生切实处理好学习与婚姻、生活的关系，结合学校实际情况，现将我校在校研究生结婚和申请生育的有关问题规定如下：

一、适用对象

我校取得学籍的在校研究生。

二、关于结婚

1.鼓励晚婚。符合法定晚婚年龄的（女23周岁以上，男25周岁以上）在校研究生申请结婚者，由本人凭居民身份证和户口卡到户口所在地民政部门按国家《婚姻登记条例》办理结婚登记手续。

2.自2007年1月1日以后办理结婚手续的研究生都要持结婚证到所在学院、研究生处及学校计生办登记备案，以便掌握其婚育状况。

3.每年新入学的研究生，凡是已婚的都要持结婚证和有关证明到所在学院、研究生处及学校计生办登记备案。

三、关于生育

1.达到晚育年龄要求生育的已婚研究生，在领取《计划生育服务手册》后方可怀孕生育。

2.已婚男生要求生育一胎的，在其配偶单位同意后，由所在学院、研究生处及学校计生办盖章，出具初婚、未育、未抱养孩子的证明后，到计划生育办公室办理有关手续。

3.已婚女生要求生育一胎的，应在当年3月底前向所在学院提出申请，经导师签字、学院同意，研究生处盖章备案后报学校计划生育办公室。由校计生办填写已婚育龄妇女信息卡纳入学校已婚未孕女职工的计划生育管理系统并办理第二年的《计划生育服务手册》后方可怀孕生育。其毕业时应该到学校计划生育办公室办理离校注册手续。

4.入学前已领取《计划生育服务手册》的女生或持“托管”、“移交”等手续的已婚女生入学后到校计划生育办公室登记备案，办理交接手续，同时到本学院和研究生处登记备案。

5.新生在入学前已怀孕的，应申请暂缓入学，在开学2周后至3个月内办理保留入学资格手续。

6.符合晚育条件的女生在读期间怀孕的，须在怀孕6个月内办理休学手续，休学时间一般不得超过一年，按两个完整学期计。有关休学和复学的具体规定参照《山东中医药大学研究生管理实施细则》第三章第四节执行。凡休学满6个月者，须在第三学年初向所在学院提交延缓毕业申请，办理延缓毕业相关手续，延缓期限不少于休学时间。

7.委培、定向在职研究生回所在单位办理生育手续。

四、相关规定

1.学校不为已婚研究生提供夫妻住房，研究生不得在校内研究生集体宿舍留宿家属。

2.对于违反《山东省人口与计划生育条例》和本规定的，根据《山东中医药大学研究生违纪处分条例》相关规定，进行批评教育，对情节严重的，给予警告或严重警告处分。

3.对于触犯《中华人民共和国婚姻法》、《中华人民共和国人口与计划生育法》等国家法律法规的，除配合司法部门追究当事人法律责任外，根据《山东中医药大学研究生管理实施细则》和《山东中医药大学研究生违纪处分条例》等相关规定，给予相应处分。

五、相关职责

学校计划生育办公室代表学校计划生育委员会负责政策把握、计划生育技术服务和工作管理的指导。研究生处负责有关学籍的管理。各学院负责管理研究生结婚和计划生育有关具体工作。

六、本规定自2007年1月1日起执行，具体由学校计划生育办公室负责解释。此前有关规定同时废止。
